Legal agreement governing your use of EAFTOS

These Terms of Service ("Terms") govern your access to and use of EAFTOS, a creator analytics and forecasting platform ("Service"). By using EAFTOS, you agree to be bound by these Terms.
Please read these Terms carefully before using our Service.
By creating an account, accessing, or using EAFTOS, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service.
You must be at least 18 years old and authorized to bind your company or organization to these Terms.
EAFTOS provides creator analytics, scoring, growth forecasting, and regime classification for social media creators across platforms including Instagram, YouTube, and TikTok.
Important Disclaimer: EAFTOS provides predictions and forecasts based on historical data and quantitative models. These are probabilistic estimates, not guarantees of future performance. Actual creator growth may differ from our forecasts.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
To use EAFTOS, you must create an account with accurate and complete information. You are responsible for:

Violation of these terms may result in immediate account termination.
EAFTOS Ownership: We own all rights to the EAFTOS platform, algorithms, scoring methodology, user interface, and related intellectual property.
Your Data: You retain ownership of the creator data you upload. By using the Service, you grant us a license to process your data to provide analytics, scoring, and forecasting.
Reports and Outputs: Creator reports and analytics generated by EAFTOS may be used for client presentations, media kits, and internal business purposes. You may not resell or redistribute EAFTOS reports as a standalone product.
Subscription fees are charged monthly or annually based on your chosen plan. Payments are processed through our secure payment provider (Stripe).
Auto-Renewal: Subscriptions automatically renew unless canceled before the renewal date.
No Refunds: We do not offer refunds for partial months or unused services. If you cancel, you retain access until the end of your billing period.
Price Changes: We may change pricing with at least 30 days' advance notice. Continued use after a price change constitutes acceptance.
No Guarantees: EAFTOS predictions are probabilistic and based on historical data. We make no warranty that creator performance will match our forecasts.
Use at Your Own Risk: EAFTOS is a decision-support tool. You are solely responsible for business decisions made using our analytics.
Not Financial or Investment Advice: EAFTOS does not provide financial, investment, or legal advice.
Data Accuracy: While we strive for accuracy, we do not guarantee that creator metrics or forecasts are error-free. Public social media data may be incomplete or delayed.
Service Provided "As Is": EAFTOS is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
Limited Liability: To the maximum extent permitted by law, EAFTOS and its affiliates shall not be liable for:
Maximum Liability: Our total liability for any claims shall not exceed the amount you paid to EAFTOS in the 12 months preceding the claim.
Your Right to Terminate: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation is effective at the end of your current billing period.
Our Right to Terminate: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or pose a security risk.
Data Upon Termination: After account cancellation, your data will be retained for 90 days (for recovery purposes) and then permanently deleted. You may request a data export before deletion.
Governing Law: These Terms are governed by the laws of the United States and the state in which EAFTOS is headquartered, without regard to conflict of law principles.
Informal Resolution: Before initiating formal proceedings, please contact us at legal@eaftos.com to attempt resolution.
Arbitration: Any disputes that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association.
Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions or representative proceedings.
We may update these Terms from time to time. If we make material changes, we will notify you via email or by posting a notice on our website at least 30 days before the changes take effect.
Your continued use of EAFTOS after the effective date of the updated Terms constitutes acceptance.
